Terms & Conditions
Definitions:
Customer: The person/s who places an order with Brandits.
Project: printed goods and web or design work undertaken by Brandits
Working days: Monday – Friday with the exception of New Zealand public holidays and any periods where Brandits is closed as stated on Brandits.co.nz
Printing
All printing undertaken must be prepaid for before dispatching to Customer.
Web hosting and Domain names
Web hosting and domain names will be charged annually unless prior arrangement made in writing. If invoice isn’t paid in full within invoice terms (7 days, unless otherwise arranged) Brandits reserve the right to cancel or take offline the website and or domain name.
Fees
Prices stated on Brandits.co.nz are in New Zealand dollars and unless otherwise stated do not include GST. GST is charged at 15% is
added to all invoices along with freight if required.
If design is requested by customer design fees will be charged at $110/hour unless a fixed fee arrangement or package deal is agreed to by both customer and Brandits.
Invoicing and Payment
Customer will be invoiced upon receipt and processing of project, if end project differs (as agreed to by both customer and Brandits) to original project then a new invoice will be resent to customer.
The invoice is a 7 day invoice from receipt of invoice.
Payment is to be received and processed before a project is dispatched. Direct credit or cheque (allow 3-7 days for payment to clear) are accepted payment methods.
Design
Design is requested by customer and charged at $110.00/hour plus GST. A fixed fee arrangement may be agreed to by both customer and Brandits. Any changes and amendments requested by customer will be charged accordingly.
Timeframe
If a project is not progressing due to Customer delays in responding then progress invoice/s will be presented, usually 30% or 50% depending on project progress to date.
Proofs
Brandits strongly recommends requesting pdf proofs and hard copy proofs. Pdf proofs will be emailed to the customer it is the customers responsibility to check for any errors, missing images or fonts or colour changes.
Hard copy proofs are $10+gst each
It is the customers responsibility to check for errors, paper suitability, colour changes, missing images or fonts.
Proofs (pdf and hard copy) will be accepted in writing (email) by the customer before project printing is commenced. Or changes to the proofs will be requested in writing (email) by the customer.
Brandits takes no responsibility for any errors including trimming errors in printed projects if both pdf and hard copy proofs are not
requested and viewed by customer
Please be aware that there will always be slight colour variations between print runs, if this is important then this isn’t a suitable print method for the customer.
Reprints
Brandits will only reprint a project with errors if pdf and hard copy proofs were requested and the error did not show on the pdf and hard copy proof.
Errors include trimming errors, missing fonts or images or different paper stock. Brandits will require you to send all of the project containing errors back to Brandits at your cost and should Brandits agree that the errors happened after proofs were accepted Brandits will happily reprint the project for the customer and resend at Brandits’s cost. The customer has 5 days from receipt of
project to reject project and make Brandits aware of any errors. If a project is rejected after this time, Brandits reserves the right to not go into dispute.
If payment is made and a customer requests and receives a hard copy proof and decides that this isn’t the right process for the project Brandits will refund the amount of printing less proof/s costs. This is the only instance in which Brandits will refund a customer otherwise Brandits will always try to rectify any printing errors by reprinting a project.
Colour
Brandits takes no responsibility for any colour variations between print runs. Slight variations are inevitable.
A file can be printed in CMYK.
There will be variation in colour between proofs and the final print.
Confidentiality
Brandits will store customers files and information for a time, we are not required to hold files for customer. Brandits will not disclose information to anyone outside of Brandits, we will send customer promotions and use customer designs to show our work on Facebook, our website and emails unless otherwise stated by customer that they would not like to be included in these.
Copyright
The copyright to any files supplied by the customer is owned by the customer. The copyright to any design work carried out by Brandits is owned by Brandits.
Brandits will never use or distribute customers files for any other purposes to the benefit of Brandits.
Project orders
Project orders are placed on Brandits.co.nz or via email to Brandits or by phone, but confirmed via email also.
Acceptance of these Terms
Once a project order is placed and confirmed, customer agrees to these terms.
Prices
Prices are subject to change without notice.
Illegal or inappropriate material
Brandits reserves the right to decline any projects that are illegal or the Brandits considers inappropriate.
Naming and Trademarks
Though we provide guidance in naming and trademarking, we in no way take any responsibility for ensuring trademarks are owned or breached in New Zealand or internationally. We highly recommend you the client seek your own trademarking advice from an Intellectual Property Legal Adviser. It is not our responsibility to ensure you the client do not breach a national or international trademark.
